(2) Článek 2 xxxxxxxx 89/109/XXX xxxxxxx, že materiály x xxxxxxxx xx xxxx konečném xxxxx xxxxxxx uvolňovat své xxxxxx xx xxxxxxxx x množstvích, která xx mohla xxxxxxx xxxxxx xxxxxx xxxx xxxxxxxx nepřijatelnou xxxxx xx složení potravin.

(3) Xxxxxxx nástrojem pro xxxxxxxx tohoto xxxx xx zvláštní xxxxxxxx xx xxxxxx xxxxxx 3 směrnice 89/109/XXX, xxxxx xxxxxx ustanovení xxxx xxxxxx použitelná xxx xxxxx xxxxxx.

(4) Xxxxxx působnosti xxxx xxxxxxxx xx xxxx xxxxxxxx x xxxxxxx xxxxxxxxxx xxxxxxxx Xxxx 82/711/XXX [4].

(5) Jelikož xxxxxxxx xxxxxxxxx x xxxx xxxxxxxx xx xxxxxxxxxx xx xxxxxxxxx xxxxxxxxxx, upraví xxxx xxxxxxxxx x xxxxxxxx xxxxx xxxxxxxx xxxxxxxx.

(6) Xxxxxxxx by měly xxx považovány za xxxxxxxxxx xxxxx xxx xx plasty x xxxx být xxxxxx x xxxxxxxx xxxxxx.

(7) Xxxxxxxxx xxxxxxx xxxxxxxxxx xxxxx s xxxxxxxxx xxxxxxxxxx limity a x xxxxxxx xxxxxxx xxxxxxxxx xxxxxx specifických xxxxxxx xxxx dostatečné x dosažení cíle xxxxxxxxxxx x článku 2 směrnice 89/109/XXX.

(8) Xxxxx xxxxxxxx x xxxxxx xxxxxxxxx látek xxxx xxxxxxxxxxx a xxxxxxxxxx na úrovni Xxxxxxxxxxxx xxxxxxxx xxxx xxxxxxxx a xxxxxxx xxxxx xxxxxxxxx a xxxxxxxx xxxxxxx v xxxxxx xxxxxxxx xxxxx, xxxxx lze používat xx jejich xxxxxxxxx Xxxxxxxx xxxxxxx pro xxxxxxxxx x xx xxxxxxxxxx o jejich xxxxxxxx xx xxxxxxx Xxxxxxxxxxxx; xxxx xxxxxxxx xxxx bude později xxxxxxxxx x xxxxxxx xxxxxxxxx xxxxx x xxxxxxx.

(9) Stávající xxxxxx xxxxxx xxxx xxxxx, xxxxx xxxxxxxxxx všechny xxxxx, které xxxx x xxxxxxxx xxxx xxxxxxxx v jednom xxxx xx xxxx xxxxxxxxx xxxxxxx; tyto xxxxx xxxx mohou xxxxxx podléhat xxxxxxxxxxxxx xxxxxxx xxxxxxxxx až xx přijetí xxxxxxxxxx x jejich xxxxxxxx xx xxxxxxx Společenství.

(10) Xxxx xxxxxxxx xxxxxxx xxxxxxxxxxx xxxxx xxx xxxxxxx látky. Xxxxxxx xxxxx, xxx xxxxx xxxx být xxxxx xxxxxxxxx xxxxxxxxxxx, xxxx xxxxxx podléhají vnitrostátním xxxxxxx xxxxxxxxx xx xx přijetí xxxxxxxxxx xx xxxxxx Společenství.

(12) Směrnice 82/711/XXX xxxxxxx základní xxxxxxxx xxx zjišťování xxxxxxx složek xxxxxxxxx x předmětů x xxxxxx a směrnice Xxxx 85/572/XXX [5] xxxxxxxx seznam xxxxxxxxx xxxxxxxxxxx xxx xxxxxxxxx xxxxxxx.

(13) Xxxxxxxxx xxxxxxxx xxxxx v konečném xxxxxxxxx xxxx xxxxxxxx xx xxxxxxxxxx xxx xxxxxxxxx xxxxxxxxx xxxx xxxxxxxxxx xxxxxxx. Xx xxxxxxxx xxxxxxxx xx xxxx mělo být xxxxxxxx ověřovat xxxxxxxxxx xxxxxxxx stanovením xxxxxxxx xxxxx xxxxx xxx xxxxxxxxxx xxxxxxxxx specifické xxxxxxx.

(14) X xxxxxxxx xxxx plastů xxxxxxxx xxxxxxxx obecně xxxxxxxx xxxxxxx xxxxxx xxxxxxxx xx experimentálních xxxxxxx xxxxxxxxx xxxxxxxx xxxxxxx xxxxx za xxxxxxxx xxxxxxxx, x vyhnout xx tak xxxxxxxxx, xxxxxxxxxx x xxxxxx xxxxxxxxx xxxxxxxx.

(15) Xxxxxxx xxxxxxxx xxxxx xx xxxxx inertnosti xxxxxxxxx, xxxxxx složení potravin xxxx nepřijatelnými xxxxxxx; xxxx xxxxxxxxxx se xxxxx xxxxxxx potřeba xxxxxxx xxxxx xxxxxxxxxxxx xxxxxxxxxx xxxxxx xxxx xxxxxx xxxxxxx, xxxx xx umožněna účinná xxxxxxxx.

(16) Xxxxxxxx Xxxx 78/142/XXX [6] stanoví xxxxxx xxx xxxxxxxx xxxxxxxxxxxxx xxxxxxxxxx x xxxxxxxxxxx a xxxxxxxxxx x xxxxxx xxxxxxxxxx x xxxx xxxxx x xxx xxxxxxxx xxxxxxxxxxxxx xxxxxxxxxx xxxxxx xxxxxxxxx a xxxxxxxx x xxxxxxxx Komise 80/766/XXX [7] a 81/432/XXX [8] xxxxxxx xxxxxxxxxx xxxxxx Společenství xxx xxxxxxxx xxxxxx xxxxxx.
