§1

Předmět úpravy

(5) Xxxxxxx xxxx xxxxxxxxx, xx nemá xxxxxxxxx xxxxxxxxxx xx pojistném xx xxxxxxx xxxxxxxxx xxxxxxxxx x xxxx xxxxxxxxxx xx xxxxxxxx x xxxxxxxxxx, xxxxx xxxxx xxxxxxx xxxxxxx xxxxxxxx xxxxx xxxxxxxx 3 nebo 4, xxxxx xxxxxxxx xxxxxxxxxxxxx xxxxxxx xxxxxxxxxxx.

§3

Prokazování xxxxxxxxxxx předpokladů

(1) Xxxxxxx prokazuje splnění xxxxxxxxxxx xxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx dokladem osvědčujícím xxxxxxxxxx energetického xxxxxxxx, xxxxxx xx

x) u xxxxxxxxxxxxx zařízení nově xxxxxxxxx do xxxxxxx xxxxxx x výchozí xxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxx xxxx právní xxxxxxx xxxxxx povinnost xxxx technická norma xxxxxxx provedení výchozí xxxxxx xxxx xxxxxxxx xx xxxxxxx,

x) u xxx xxxxxxxxxxxxx energetických xxxxxxxx xxxxxx x xxxxxxx xxxxxx, pokud xxxxxxxxx povinnost xxxxxxx xxxxxxxxxxx nebo provozní xxxxxx xxxxxxxxxxxxx zařízení, xxxxx xxxxxx o xxxxxxxxxx xxxx provozní xxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxxx x xxxxxxxxx xxxxxxx xxxxxxxxxxxxx zařízení, xxxxx jiný xxxxxx xxxxxxx xxxx xxxxxxxxx xxxxx xxxxxx xxxxxxxxx xxxxxxxxx xxxxxx xxxxxxxxxxxxx xxxxxxxx xxxx zkoušek xxxxxxxxxxxxx xxxxxxxx, nebo

(3) Doklady xxxxxxxxxxx bezpečnost xxxxxxxxxxxxx xxxxxxxx podle odstavce 1 xxxx 2 xxxxxxx xxx xx xxx, xx kterému xxxx xxxxxxxxxxx Energetickému xxxxxxxxxxx úřadu (xxxx xxx "Xxxx"), starší 6 xxxxxx, xxxxx xxxx právní předpis xxxx xxxxxxxxx xxxxx xxxxxxxxx xxx xxxxxx xxxxxxxxx xxxxx lhůtu.

(4) Xxxxxxx xxxxxxxxx xxxxxxx xxxxxxxxxxx předpokladů xxxx

x) xxxxxxxxxxx x xxxxxxxx x nakládání x xxxxxx, pokud je xxxxx xxxxxxx xxxxxx xxxxxxxx k xxxxxxxxx x xxxxxx xxxxxxxxx x xxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx,

§4

Xxxxxxxxxxx xxxxxxx xxxxxxxxxxxx

(1) Xxxxxxx xxxxxxx dosažené xxxxxxxx xxxxxxxx, xxxxxxxxxx xxxxxxxxxxx, xxxxxxx xxxxxx xxxx xxxxx xxxxxxxx x dosaženém xxxxxxxx. Xxxxxxxx rekvalifikace dokládá xxxxxxx xxxxxxxxxx x xxxxxxxxxxxxx xxxxxxx rekvalifikačním xxxxxxxxx v souladu x xxxxxxxx xxxxxxxx xxxxxxxx v xxxx xxxxxxxx xxxx xxxxxxxxxxxxx.

(2) Xxxxxxx dokládá získání xxxxx v xxxxx xxxxxxxxxx x xxxxxxxxxx xxxx xxxxxxxxx posudkem²⁾, xxxxxxxxx xxxxx xxxxxxxxxxx xxxxxxxx, xxxxxx-xx xxxxx x oboru x xxxxxxxxx nebo xxxxx xxxxxxxx xxxxxx. Xxxxxx-xx xxxxxxx praxi x xxxxx xxxxxxx xxxxxxxxxxxxx xxxxxxxx, dokládá xxxxxxxx xxxxx

(3) Xxx xxxxxxxxxxx xxxxxxx odborné xxxxxxxxxxx xxxx xxxx xxxxxxxxxxxx xxxxxxxx příslušníků států Xxxxxxxx xxxx xx xxxxxxxxx podle zákona x xxxxxxxx xxxxxxx xxxxxxxxxxx³⁾.

§5

Xxxxxxxxxxx xxxxxxxxxxxx nebo xxxxxxxxx práva x xxxxxxxxxxxxx xxxxxxxx

(1) Xxxxxxxxxx xxxxx k xxxxxxxxxxxxx xxxxxxxx žadatel xxxxxxxxx

x) xxxxxxx x xxxxxxxx xxxxxxxxxxx, xxxxxxxx-xx xx xxxxxxxxxx xxxxx xx xxxxxxxx xxxxxxxxxxx, xxxx

x) xxxxxxxx xxxx xxxxx xxxxxxxx x nabytí xxxxxxxxxxxx práva, nezapisuje-li xx vlastnické xxxxx xx katastru xxxxxxxxxxx.

(2) Xxxxxxx právo x xxxxxxxxxxxxx xxxxxxxx žadatel xxxxxxxxx

x) výpisem z xxxxxxxx xxxxxxxxxxx, xxxxxxx-xx xxxxx xxxxxx xxxxxxxxxx xx xxxxxx x xxxxxxxx xxxxxxxxxxx, nebo

b) xxxxxxxx, xx základě xxxxx xxxxxxxx xxxxxx xxxxx xxxxxx xxxx xxxxxxxxxxx xxxxxxxx, případně xxxxx dokladem xxxxxxxxxxxx xxxxxxxxx xxxxxxxxx xxxxx, xxxxxxxxxx-xx xx xxxxxxx xxxxx do katastru xxxxxxxxxxx.

(3) Xxxxx-xx vlastnické xxxxx xxxx xxxxxxx xxxxx k energetickému xxxxxxxx prokázat xxxxxxx xxxxxxxxx x odstavci 1 xxxx 2, xxx takové právo x energetickému zařízení xxxxxxxx i xxxxx xxxxxxxx xxxxxxxxxxxxx důvodné xxxxxxxxxxx.

(4) Není-li xxxxxxx xxxxxxxxxx energetického xxxxxxxx, xxxxxxx na vyžádání Xxxxx i vlastnické xxxxx xxxxxxxxx xxxxxxx xxxxxxxxx v xxxxxxxxxx 1 xx 3.

§6

Xxxxxx xxxxxxxxxx xxxxx

(1) Xxxxxxxx území xx x žádosti x xxxxxxx xxxxxxx a xxxxxxxxx přikládaných k xxxxxxx xxxxxx xxx xxxxxxxxxxxx xxxxxxx xxxxxxxxxx xxxxxxxxx, xxxxxxxxxx xxxxx xxxx xxxxxxx xxxxxxx xxxxxxx

§7

Xxxxxx xxxxxxxxxx
