§1

Xxxxxxx xxxxxx

(1) Xxxx xxxxxxxx xxxxxxx způsoby xxxxxxxxxxx finančních x xxxxxxxxxxx xxxxxxxxxxx a xxxxxxx xxxxxxxxxxxx xxx xxxxxxxxxx xxxxx licencí, xxxxxxx xxxxxx xxxxxxxxxx xxxxx a xxxxxxxxxx, xxxxxxxxx vlastnického xxxx xxxxxxxxx xxxxx x xxxxxxx energetického zařízení, xxxxxxxxxxx prohlášení odpovědného xxxxxxxx x vzory xxxxxxx x xxxxxxx, xxxxx a zrušení xxxxxxx a xxxxx xxxxxxx o xxxxxx xxxxxxxxx k xxxxxxxxx xxxxxxxxx x xxxxx xxxxxxxx státě Xxxxxxxx xxxx.

(2) Tato xxxxxxxx xxxx stanoví xxxxx xxxxxxxxx na podávání xxxxxxx x udělení xxxxxxxxx x xxxxxxxx xxxxxxxxxxxxxxxxx x xxxxxxx x xxxxxxxxxxx xxxxxxxxx xxxxxxxxx x xxxxxxxx xxxxxxxxxxxxxxxxx.

§2

Xxxxxxxxxxx xxxxxxxxxx předpokladů

(1) Xxxxxxx x xxxxxxx xxxxxxx xxx podnikání x energetických xxxxxxxxx (xxxx jen "žadatel") xxxxxxxxx xxxxxxxx xxxxxxxxxxx

x) xxxxxxx dostupných xxxxxxxxx xxxxxxxxxx k xxxxxxxxx xxxxxx xxxxxxxxxxx činnosti x xxxxxxxxxx rozsahu xxxxxxxxxxxxx xxxxxxx x), x xx

1. xxxxxxxxx xxxxxx x xxxx x xxxxxxxxxxx x xxxxxxxxx xxxxxxxxxx xx xxxxxxxxxx 12 xxxxxxxxxxxxxxx xxxxxxxxxxxx měsíců xxxx xx xxxxxx období, xxxxxxxxxx-xx xxxxxxx xxxxxxxxxxxxxx xxxxxxx xx xxxx xxxxxxx xxxxxxx roku,

(4) Xxxxxxx xxxx xxxxxxxxx potvrzením xxxxxxx xxxxxxxxxx xxxxxxx xxxxxxx sociálního xxxxxxxxxxx, xx xxxx xxxxxxxxx xxxxxxxxxx na pojistném x xx penále xx xxxxxxxx zabezpečení x xxxxxxxxx na xxxxxx xxxxxxxx xxxxxxxxxxxxx.

(5) Xxxxxxx xxxx xxxxxxxxx, xx nemá xxxxxxxxx xxxxxxxxxx xx xxxxxxxxx xx veřejné zdravotní xxxxxxxxx x jiné xxxxxxxxxx xx xxxxxxxx x poplatcích, xxxxx xxxxx xxxxxxx xxxxxxx xxxxxxxx xxxxx xxxxxxxx 3 xxxx 4, xxxxx způsobem nevzbuzujícím xxxxxxx xxxxxxxxxxx.

(6) Xxxxx xxxx xxxxxxxx předpoklady xxxxx xxxxxxxx 1 xxxx. a) xxxx 3 prokazovány smlouvou xxxxxxxxx xx xxxxxxxx xxxxxx xxxxx zákona xxxxxxxxxxxx xxxx x xxxxxx, je žadatel x xxxxxxx licence xxxxxxx xxxxxxxxx doklady xxxxx xxxxxxxx 1 xxxx. x) xxxx 1 nebo 2 x xx xxxx xxxxx.

(7) Xxxxxxxx předpoklady xxxxxxxx podle xxxxxxxx 1 písm. a) x x) xxxxxxxxxxx xxxxxxx x udělení xxxxxxx na výrobu xxxxxxxxx nebo xxxxxxx x udělení licence xxx xxxxxxxx xxxxxxxxx, xxxxx xx xxxxxxxxxxx xxxxx xxxxxxx xxxxxxxxx xxxx xxxxxxxx xxx xxxxxxxx xxxxxxxxx nižší xxx 1 MW.

(8) Xxxxxxx xxxxxxxxxxx xxxxxxxx xxxxxxxxxxx xxxxxxxx xxxxx xxxxxxxx 2 xx 5 xxxxxxx xxx xx xxx, ke xxxxxxx jsou předkládány Xxxxxxxxxxxxx xxxxxxxxxxx xxxxx, xxxxxx6xxxxxx, pokud xxxx xxxxxx xxxxxxx nestanoví xxx jejich provedení xxxxx xxxxx.

§3

Xxxxxxxxxxx xxxxxxxxxxx xxxxxxxxxxx

(1) Xxxxxxx xxxxxxxxx splnění xxxxxxxxxxx xxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx xxxxxxxx osvědčujícím xxxxxxxxxx xxxxxxxxxxxxx zařízení, xxxxxx je

a) x xxxxxxxxxxxxx xxxxxxxx xxxx xxxxxxxxx do xxxxxxx xxxxxx x výchozí xxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxx xxxx xxxxxx xxxxxxx xxxxxx povinnost xxxx technická xxxxx xxxxxxx xxxxxxxxx xxxxxxx xxxxxx před xxxxxxxx xx xxxxxxx,

(2) Xxxxxx xxxxxxxxxxx xxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx xx xxxxx xxxxxxxx xxxxxxxx xxxxxxxxxxx xxxxxxx xxxxxxxxx xxxxxxxxxx podle xxxxxx xxxxxxxxxxxx xxxxxxxxxx xxxxx x xxxxxxxxxxx s xxxxxxxx xxxxxxxxxxx technických xxxxxxxx, xxxx xxxxxxxxx xxxxxxxx xxxxxxxxxxxx bezpečnost xxxxxxxxxxxxx xxxxxxxx.

(4) Xxxxxxx prokazuje xxxxxxx xxxxxxxxxxx xxxxxxxxxxx xxxx

x) xxxxxxxxxxx x povolení x nakládání s xxxxxx, xxxxx je xxxxx xxxxxxx xxxxxx xxxxxxxx x xxxxxxxxx x vodami podmínkou x xxxxxxxxxxx energetického xxxxxxxx,

x) xxxxxxxxxxx x xxxxxxxx x xxxxxxxxx xxxxxxxx činnosti, xxxxx xx podle zákona x hornické xxxxxxxx, xxxxxxxxxxx x o xxxxxx xxxxxx xxxxxx xxxxxxxx k příslušné xxxxxxxx xxxxxxxx xxxxxxxxx x provozování xxxxxxxxxxxxx xxxxxxxx.

(5) Podléhá-li xxxxxxxxxxx xxxxxxxx povolení xxxxxx xxxxx xxxxxxxxxx xxxxxx, xxxxxxxxx xxxxxxx xxxxxxx xxxxxxxxxxx předpokladů xxxxxxxxxxxxx xxxxxxxx xxxx x

x) xxxxxxxxx xxxxxxxxx xxxxxxxxxxxxx xxxxxxxx xxxxxxxxx xxxxxxxxxx xxxxx x předčasnému xxxxxxx xxxxxx před xxxx xxxxxx dokončením,

§4

Prokazování xxxxxxx způsobilosti

(1) Xxxxxxx xxxxxxx dosažené xxxxxxxx xxxxxxxx, maturitním xxxxxxxxxxx, výučním xxxxxx xxxx jiným xxxxxxxx x dosaženém xxxxxxxx. Xxxxxxxx rekvalifikace xxxxxxx xxxxxxx xxxxxxxxxx x xxxxxxxxxxxxx xxxxxxx rekvalifikačním xxxxxxxxx x souladu x xxxxxxxx xxxxxxxx xxxxxxxx x době xxxxxxxx xxxx xxxxxxxxxxxxx.

(2) Xxxxxxx xxxxxxx xxxxxxx xxxxx x xxxxx xxxxxxxxxx x xxxxxxxxxx xxxx pracovním posudkem²⁾, xxxxxxxxx xxxxx xxxxxxxxxxx xxxxxxxx, xxxxxx-xx xxxxx x xxxxx v xxxxxxxxx nebo xxxxx xxxxxxxx xxxxxx. Získal-li xxxxxxx xxxxx x xxxxx xxxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxxxx získanou xxxxx

x) výpisem ze xxxxxxxxxxxxxx xxxxxxxxx xxxx xxxxxxxxx xxxxxxxxx xxxxxxxx x xxxxx xxxxx x

x) xxxxxxx xxxxxxxxx xxxx xxxxx xxxxxxxx, x xxxxx je xxxxxx, že vykonával xxxxx xxxxxxxxxxxxxx xxxxxxx x xxxxx xx xxxx xxxxxxxxxxx energetickým xxxxxxx.

(3) Xxx xxxxxxxxxxx xxxxxxx odborné xxxxxxxxxxx xxxx xxxx způsobilosti xxxxxxxx xxxxxxxxxxx xxxxx Xxxxxxxx unie xx xxxxxxxxx xxxxx zákona x uznávání xxxxxxx xxxxxxxxxxx³⁾.

§5

Prokazování xxxxxxxxxxxx xxxx xxxxxxxxx xxxxx k xxxxxxxxxxxxx zařízení

(1) Vlastnické xxxxx k xxxxxxxxxxxxx xxxxxxxx žadatel prokazuje

a) xxxxxxx z xxxxxxxx xxxxxxxxxxx, xxxxxxxx-xx se xxxxxxxxxx právo xx xxxxxxxx xxxxxxxxxxx, nebo

b) xxxxxxxx xxxx xxxxx xxxxxxxx x xxxxxx xxxxxxxxxxxx xxxxx, xxxxxxxxxx-xx xx xxxxxxxxxx právo xx katastru xxxxxxxxxxx.

(2) Xxxxxxx právo x xxxxxxxxxxxxx xxxxxxxx xxxxxxx xxxxxxxxx

x) xxxxxxx x xxxxxxxx xxxxxxxxxxx, xxxxxxx-xx xxxxx xxxxxx xxxxxxxxxx xx xxxxxx v xxxxxxxx xxxxxxxxxxx, nebo

b) xxxxxxxx, xx základě xxxxx xxxxxxxx xxxxxx xxxxx xxxxxx dané xxxxxxxxxxx zařízení, xxxxxxxx xxxxx xxxxxxxx xxxxxxxxxxxx xxxxxxxxx xxxxxxxxx práva, xxxxxxxxxx-xx se užívací xxxxx do xxxxxxxx xxxxxxxxxxx.

(3) Xxxxx-xx xxxxxxxxxx xxxxx xxxx xxxxxxx xxxxx x energetickému xxxxxxxx prokázat xxxxxxx xxxxxxxxx x xxxxxxxx 1 xxxx 2, xxx takové xxxxx x xxxxxxxxxxxxx xxxxxxxx xxxxxxxx i xxxxx xxxxxxxx nevzbuzujícím xxxxxxx xxxxxxxxxxx.

(4) Xxxx-xx xxxxxxx xxxxxxxxxx xxxxxxxxxxxxx zařízení, xxxxxxx na xxxxxxxx Xxxxx i vlastnické xxxxx vlastníka xxxxxxx xxxxxxxxx v xxxxxxxxxx 1 xx 3.

§6

Určení xxxxxxxxxx xxxxx

(1) Xxxxxxxx xxxxx xx x žádosti o xxxxxxx xxxxxxx x xxxxxxxxx přikládaných k xxxxxxx xxxxxx xxx xxxxxxxxxxxx činnost xxxxxxxxxx xxxxxxxxx, xxxxxxxxxx xxxxx xxxx xxxxxxx tepelné xxxxxxx

x) xxxxxxxx xxxxxxxxxxxxx xxxxx x xxxxxxxxx xxxxx xxxx xxxxxxxx xxxxxxxxxxxxx xxxxx xxxxxx xxxxxxxxxx xxxxx xxxxxxx xxxxx katastru xxxxxxxxxxx, xx nichž se xxxxxxxxx zařízení xxxxxxxxxxx xxxxxxxx xxxx xxxxxxxxxx xxxxxxxxx xxxxxxxx,

§7

Určení xxxxxxxxxx
