§1

Xxxxxxx úpravy

(1) Xxxx xxxxxxxx stanoví xxxxxxx xxxxxxxxxxx xxxxxxxxxx x xxxxxxxxxxx xxxxxxxxxxx x xxxxxxx xxxxxxxxxxxx xxx xxxxxxxxxx xxxxx xxxxxxx, xxxxxxx určení vymezeného xxxxx a provozovny, xxxxxxxxx xxxxxxxxxxxx xxxx xxxxxxxxx xxxxx x xxxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxxxxxxxx prohlášení xxxxxxxxxxx xxxxxxxx x vzory xxxxxxx x udělení, xxxxx x xxxxxxx xxxxxxx a vzory xxxxxxx o uznání xxxxxxxxx x xxxxxxxxx xxxxxxxxx v xxxxx xxxxxxxx státě Xxxxxxxx xxxx.

(2) Xxxx xxxxxxxx xxxx xxxxxxx xxxxx xxxxxxxxx xx xxxxxxxx xxxxxxx x xxxxxxx xxxxxxxxx x xxxxxxxx xxxxxxxxxxxxxxxxx x xxxxxxx x xxxxxxxxxxx xxxxxxxxx xxxxxxxxx x xxxxxxxx xxxxxxxxxxxxxxxxx.

§2

Prokazování xxxxxxxxxx xxxxxxxxxxx

(1) Xxxxxxx x udělení xxxxxxx xxx xxxxxxxxx x energetických xxxxxxxxx (xxxx jen "žadatel") xxxxxxxxx xxxxxxxx předpoklady

a) xxxxxxx dostupných xxxxxxxxx xxxxxxxxxx x xxxxxxxxx xxxxxx xxxxxxxxxxx xxxxxxxx x plánovaném xxxxxxx xxxxxxxxxxxxx písmenu c), x xx

1. měsíčními xxxxxx x xxxx x xxxxxxxxxxx a xxxxxxxxx xxxxxxxxxx za xxxxxxxxxx 12 xxxxxxxxxxxxxxx xxxxxxxxxxxx měsíců nebo xx xxxxxx xxxxxx, xxxxxxxxxx-xx žadatel podnikatelskou xxxxxxx xx xxxx xxxxxxx jednoho xxxx,

2. xxxxxxxxxx xxxxx xxxx xxxxxxxxxx banky, x xxx xx xxxxxxx xxxxx účet, o xxxxxxxx na xxxx xx posledních 12 xxxxxxxxxxxxxxx xxxxxxxxxxxx xxxxxx xxxx za xxxxxx xxxxxx, xxxxxxxxxx-xx xxxxxxx xxxxxxxxxxxxxx činnost xx xxxx alespoň jednoho xxxx, xxxx

(3) Xxxxxxx xxxx prokazuje xxxxxxxxxx xxxxxxxxxxx xxxxxx, xx xxxx evidován xxxxxxxxxx u xxxxxx Xxxxxxxx xxxxxx Xxxxx xxxxxxxxx x xxxxxx Xxxxx správy Xxxxx xxxxxxxxx.

(4) Xxxxxxx dále xxxxxxxxx potvrzením xxxxxxx xxxxxxxxxx okresní xxxxxxx xxxxxxxxxx zabezpečení, xx xxxx xxxxxxxxx nedoplatky xx xxxxxxxxx x xx penále na xxxxxxxx xxxxxxxxxxx x xxxxxxxxx na státní xxxxxxxx zaměstnanosti.

(5) Žadatel xxxx prokazuje, xx xxxx evidovány nedoplatky xx xxxxxxxxx na xxxxxxx zdravotní xxxxxxxxx x xxxx xxxxxxxxxx xx xxxxxxxx x xxxxxxxxxx, xxxxx xxxxx xxxxxxx xxxxxxx xxxxxxxx xxxxx odstavce 3 xxxx 4, xxxxx xxxxxxxx xxxxxxxxxxxxx důvodné xxxxxxxxxxx.

(6) Xxxxx jsou xxxxxxxx xxxxxxxxxxx podle xxxxxxxx 1 písm. x) bodu 3 xxxxxxxxxxx xxxxxxxx xxxxxxxxx xx spojenou osobou xxxxx xxxxxx xxxxxxxxxxxx xxxx x xxxxxx, xx xxxxxxx x xxxxxxx licence xxxxxxx xxxxxxxxx xxxxxxx xxxxx xxxxxxxx 1 xxxx. x) bodu 1 xxxx 2 i xx xxxx xxxxx.

§3

Xxxxxxxxxxx technických xxxxxxxxxxx

(1) Xxxxxxx prokazuje xxxxxxx xxxxxxxxxxx předpokladů xxxxxxxxxxxxx xxxxxxxx xxxxxxxx osvědčujícím xxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxxx je

a) u xxxxxxxxxxxxx xxxxxxxx xxxx xxxxxxxxx xx xxxxxxx xxxxxx x výchozí xxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxx xxxx xxxxxx xxxxxxx ukládá povinnost xxxx xxxxxxxxx norma xxxxxxx xxxxxxxxx xxxxxxx xxxxxx před xxxxxxxx xx provozu,

b) x xxx provozovaných xxxxxxxxxxxxx xxxxxxxx xxxxxx x xxxxxxx xxxxxx, xxxxx xxxxxxxxx povinnost xxxxxxx xxxxxxxxxxx nebo provozní xxxxxx energetického zařízení, xxxxx xxxxxx x xxxxxxxxxx nebo provozní xxxxxx xxxxxxxxxxxxx zařízení, xxxxxx x xxxxxxxxx xxxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxx jiný xxxxxx xxxxxxx nebo xxxxxxxxx xxxxx ukládá xxxxxxxxx xxxxxxxxx revize xxxxxxxxxxxxx xxxxxxxx xxxx xxxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxx

(2) Xxxxxx osvědčující xxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx je xxxxx xxxxxxxx xxxxxxxx xxxxxxxxxxx vydaným xxxxxxxxx xxxxxxxxxx xxxxx xxxxxx xxxxxxxxxxxx xxxxxxxxxx xxxxx x souvislosti s xxxxxxxx vyhrazených xxxxxxxxxxx xxxxxxxx, nebo xxxxxxxxx xxxxxxxx xxxxxxxxxxxx xxxxxxxxxx xxxxxxxxxxxxx zařízení.

(3) Xxxxxxx xxxxxxxxxxx xxxxxxxxxx energetického xxxxxxxx xxxxx odstavce 1 xxxx 2 xxxxxxx xxx xx xxx, xx kterému xxxx xxxxxxxxxxx Xxxxxxxxxxxxx xxxxxxxxxxx xxxxx (xxxx xxx "Xxxx"), xxxxxx 6 xxxxxx, pokud xxxx xxxxxx xxxxxxx xxxx xxxxxxxxx norma xxxxxxxxx xxx xxxxxx xxxxxxxxx xxxxx lhůtu.

(4) Xxxxxxx xxxxxxxxx splnění xxxxxxxxxxx xxxxxxxxxxx dále

a) xxxxxxxxxxx x xxxxxxxx x nakládání s xxxxxx, xxxxx xx xxxxx vodního zákona xxxxxxxx x xxxxxxxxx x xxxxxx xxxxxxxxx x provozování energetického xxxxxxxx,

x) xxxxxxxxxxx x xxxxxxxx x xxxxxxxxx xxxxxxxx činnosti, xxxxx xx xxxxx zákona x xxxxxxxx xxxxxxxx, xxxxxxxxxxx a o xxxxxx xxxxxx správě xxxxxxxx k xxxxxxxxx xxxxxxxx činnosti xxxxxxxxx x provozování xxxxxxxxxxxxx xxxxxxxx.

(5) Je-li xxxxxxxxxxx xxxxxxxx stavbou xxxxx xxxxxxxxxx xxxxxx, xxxxxxxxx xxxxxxx xxxxxxx technických xxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx xxxx x

x) předčasně xxxxxxxxx xxxxxxxxxxxxx xxxxxxxx xxxxxxxxx xxxxxxxxxx úřadu x xxxxxxxxxxx xxxxxxx xxxxxx xxxx xxxx xxxxxx dokončením,

b) xxxxxxxxxxxxx xxxxxxxx xx xxxxxxxxx xxxxxxx

1. xxxxxxxxx povolením, xxxxx xxxxxxxxx xxxxxxxxxx xxxxxxx xxxxxx stavební xxxx xx xxxxxxxxx xxxxxxxx, xxxx

2. xxxxxxxxxxx xxxxxxxxxx xxxxx o xxxxxxxx nebo nařízení xxxxxxxxxx xxxxxxx,

x) xxxxxxxxx xxxxxxxxxxxxx xxxxxxxx xxxx xxxxxxxxx xx provozu

1. xxxxxxx xxxxxxxxxxx, pokud xx jedná x xxxxxx xxxx zařízení, xxxxx xxxxxxxxxx stavební xxxxxxxx xxx xxxxxxxx,

2. xxxxxxx xxxxxxxxx, pokud xx xxxxx o xxxxxx nebo xxxxxxxx, xxxxx nevyžadují xxxxxxxx xxxxxxxx xxx ohlášení,

3. xxxxxxxxxxxxx xxxxxxxx, xxxxx xx xxxxx o xxxxxx nebo xxxxxxxx, xxxxx xxxxxxxxxx xxxxxxxx xxxxxxxx xxx ohlášení,

4. xxxxxxxxxx xxxxxx xxxxxxxxxxxx xxxxxxxxx xxxxxx xxxxxxxxxx, xxxxx xx xxxxx x xxxxxx xxxx xxxxxxxx, xxxxx xxxxxxxxxx xxxxxxxx povolení xxx xxxxxxxx, xxxx

5. xxxxxxxxxxx xxxxxxxxx,

x) již xxxxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx

§4

Prokazování xxxxxxx xxxxxxxxxxxx

(1) Xxxxxxx xxxxxxx xxxxxxxx xxxxxxxx xxxxxxxx, maturitním xxxxxxxxxxx, xxxxxxx xxxxxx xxxx jiným xxxxxxxx x dosaženém xxxxxxxx. Xxxxxxxx xxxxxxxxxxxxx dokládá xxxxxxx osvědčením o xxxxxxxxxxxxx xxxxxxx xxxxxxxxxxxxxxx xxxxxxxxx x xxxxxxx x xxxxxxxx xxxxxxxx xxxxxxxx v xxxx xxxxxxxx dané rekvalifikace.

(2) Xxxxxxx xxxxxxx získání xxxxx v oboru xxxxxxxxxx o zaměstnání xxxx pracovním posudkem²⁾, xxxxxxxxx jiným hodnověrným xxxxxxxx, získal-li praxi x oboru x xxxxxxxxx xxxx jiném xxxxxxxx xxxxxx. Xxxxxx-xx xxxxxxx xxxxx x xxxxx xxxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxxxx xxxxxxxx xxxxx

x) xxxxxxx xx xxxxxxxxxxxxxx rejstříku xxxx xxxxxxxxx xxxxxxxxx vedeného x xxxxx státě x

x) daňovým přiznáním xxxx xxxxx xxxxxxxx, x xxxxx xx xxxxxx, xx xxxxxxxxx xxxxx xxxxxxxxxxxxxx xxxxxxx x xxxxx xx xxxx xxxxxxxxxxx xxxxxxxxxxxx xxxxxxx.

(3) Při xxxxxxxxxxx xxxxxxx odborné xxxxxxxxxxx xxxx xxxx způsobilosti xxxxxxxx xxxxxxxxxxx států Xxxxxxxx unie se xxxxxxxxx podle xxxxxx x xxxxxxxx xxxxxxx xxxxxxxxxxx³⁾.

§5

Prokazování vlastnického xxxx xxxxxxxxx práva x xxxxxxxxxxxxx xxxxxxxx

(1) Xxxxxxxxxx xxxxx x energetickému xxxxxxxx žadatel xxxxxxxxx

x) xxxxxxx x xxxxxxxx xxxxxxxxxxx, xxxxxxxx-xx se xxxxxxxxxx xxxxx xx xxxxxxxx nemovitostí, nebo

b) xxxxxxxx xxxx jiným xxxxxxxx o xxxxxx xxxxxxxxxxxx práva, xxxxxxxxxx-xx xx xxxxxxxxxx právo xx xxxxxxxx nemovitostí.

(2) Xxxxxxx xxxxx x xxxxxxxxxxxxx xxxxxxxx žadatel xxxxxxxxx

x) xxxxxxx x xxxxxxxx nemovitostí, xxxxxxx-xx xxxxx xxxxxx xxxxxxxxxx xx xxxxxx x xxxxxxxx xxxxxxxxxxx, xxxx

x) xxxxxxxx, xx xxxxxxx xxxxx xxxxxxxx vzniká xxxxx užívat xxxx xxxxxxxxxxx zařízení, případně xxxxx xxxxxxxx xxxxxxxxxxxx xxxxxxxxx užívacího práva, xxxxxxxxxx-xx xx xxxxxxx xxxxx xx katastru xxxxxxxxxxx.

(3) Xxxxx-xx xxxxxxxxxx xxxxx nebo xxxxxxx xxxxx k xxxxxxxxxxxxx xxxxxxxx xxxxxxxx způsoby xxxxxxxxx v xxxxxxxx 1 nebo 2, xxx xxxxxx právo x xxxxxxxxxxxxx xxxxxxxx xxxxxxxx x jiným xxxxxxxx nevzbuzujícím xxxxxxx xxxxxxxxxxx.

(4) Xxxx-xx xxxxxxx xxxxxxxxxx xxxxxxxxxxxxx zařízení, xxxxxxx xx vyžádání Xxxxx x xxxxxxxxxx xxxxx vlastníka xxxxxxx xxxxxxxxx v xxxxxxxxxx 1 xx 3.

§6

Určení xxxxxxxxxx xxxxx

(1) Xxxxxxxx území xx x xxxxxxx o xxxxxxx xxxxxxx x xxxxxxxxx přikládaných x xxxxxxx určuje pro xxxxxxxxxxxx činnost xxxxxxxxxx xxxxxxxxx, distribuce xxxxx xxxx xxxxxxx xxxxxxx xxxxxxx

x) xxxxxxxx xxxxxxxxxxxxx xxxxx x souvislém xxxxx xxxx seznamem xxxxxxxxxxxxx xxxxx včetně xxxxxxxxxx xxxxx pozemků xxxxx katastru nemovitostí, xx nichž se xxxxxxxxx zařízení distribuční xxxxxxxx xxxx xxxxxxxxxx xxxxxxxxx zařízení, x

x) xxxxxxxx xxxxxxxx xxxxxxxxxxxxx xxxxxxxx do katastrální xxxx x xxxxxxx, xxxxx odpovídá rozsahu xxxxxxxxxxxxx zařízení xxxxxxxxx x žádosti a xxxxxxxx xxxxxxxxxx zákresu.

(2) Xxxxxxx o udělení xxxxxxx na xxxxxxx xxxxxxx elektřiny nebo xxxxxxxx plynu xxxx xxxxxxxxx

x) xxxxxx xxxxxxxx xxxxxxxxx xxxx přepravní xxxxxxxx; xxxxxxx xxxxx xxxxxxxxx xxxxx x xxxxxxxxxxx xxxx xxxxxxxxx xxxxxxx xxxx přenosovou xxxx přepravní xxxxxxxxx x xxxxxxxxx xxxxxxxxxx xxxxxxxxxxxx xxxx xxxxxxxxxxx xxxxxxxx, xxxxx xxxxxx xxxxxxxx xxxxxxxxx xxxx xxxxxxxxx soustavy x xxxxxxx xxxxxx vedení xx xxxxxxxxxxx xxxx x
