§2

Prokazování xxxxxxxxxx xxxxxxxxxxx

(1) Xxxxxxx x xxxxxxx xxxxxxx xxx xxxxxxxxx x energetických xxxxxxxxx (xxxx xxx "žadatel") xxxxxxxxx finanční předpoklady

a) xxxxxxx xxxxxxxxxx xxxxxxxxxx xxxxxxxxxx, a xx:

1. xxxxxxxxx xxxxxx z xxxxxxxxxx xxxx x xxxxxxxxxxx a xxxxxxxxx xxxxxxxxxx xx posledních 12 xxxxxxxxxxxxxxx kalendářních xxxxxx nebo za xxxxxx xxxxxx, xxxxxxxxxx-xx xxxxxxxxxxxxxx činnost xx xxxx alespoň xxxxxxx xxxx,

§3

Xxxxxxxxxxx xxxxxxxxxxx xxxxxxxxxxx

(1) Xxxxxxx prokazuje splnění xxxxxxxxxxx xxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx dokladem xxxxxxxxxxxx xxxxxxxxxx xxxxxxxxxxxxx zařízení, xxxxxx xx

x) x xxxxxxxxxxxxx xxxxxxxx xxxx xxxxxxxxx xx xxxxxxx xxxxxx x xxxxxxx xxxxxx xxxxxxxxxxxxx xxxxxxxx, xxxxx jiný xxxxxx xxxxxxx xxxxxx xxxxxxxxx xxxx xxxxxxxxx xxxxx xxxxxxx provedení xxxxxxx xxxxxx před uvedením xx xxxxxxx,

(4) Žadatel xxxxxxxxx xxxxxxx xxxxxxxxxxx xxxxxxxxxxx xxxx

x) xxxxxxxxxxx x xxxxxxxx k xxxxxxxxx x vodami, pokud xx podle xxxxxxx xxxxxx xxxxxxxx x xxxxxxxxx x xxxxxx xxxxxxxxx k provozování xxxxxxxxxxxxx zařízení,

b) xxxxxxxxxxx x povolení x xxxxxxxxx hornické xxxxxxxx, xxxxx xx xxxxx xxxxxx x xxxxxxxx xxxxxxxx, výbušninách x x státní báňské xxxxxx povolení x xxxxxxxxx xxxxxxxx činnosti xxxxxxxxx x provozování xxxxxxxxxxxxx xxxxxxxx.

(5) Je-li xxxxxxxxxxx xxxxxxxx stavbou xxxxx stavebního zákona, xxxxxxxxx xxxxxxx xxxxxxx xxxxxxxxxxx xxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxx dále x

2. xxxxxxx xxxxxxxxx, xxxxx xx jedná x xxxxxx xxxx xxxxxxxx, xxxxx nevyžadují xxxxxxxx xxxxxxxx ani xxxxxxxx,

3. xxxxxxxxx xxxxxx xxxxxxx x xxxxxxxx xxxxxx xxxxxxxxxx úřadu x xxxxxxxx prohlášením žadatele, xx stavební xxxx xxxxxxx xxxxxx xxxxxxxxx,

§4

Xxxxxxxxxxx xxxxxxx xxxxxxxxxxxx

(1) Xxxxxxx xxxxxxx xxxxxxxx xxxxxxxx xxxxxxxx, maturitním xxxxxxxxxxx, xxxxxxx xxxxxx xxxx xxxxx xxxxxxxx x xxxxxxxxx xxxxxxxx. Xxxxxxxx xxxxxxxxxxxxx dokládá xxxxxxx xxxxxxxxxx x xxxxxxxxxxxxx vydaným xxxxxxxxxxxxxxx xxxxxxxxx x xxxxxxx x právními předpisy xxxxxxxx v xxxx xxxxxxxx xxxx xxxxxxxxxxxxx.

(2) Xxxxxxx xxxxxxx získání xxxxx v xxxxx xxxxxxxxxx x zaměstnání xxxx xxxxxxxxx xxxxxxxx²⁾, xxxxxxxxx xxxxx xxxxxxxxxxx xxxxxxxx, xxxxxx-xx xxxxx x xxxxx x xxxxxxxxx nebo xxxxx xxxxxxxx xxxxxx. Xxxxxx-xx xxxxxxx xxxxx v xxxxx výkonem podnikatelské xxxxxxxx, xxxxxxx xxxxxxxx xxxxx

x) výpisem xx xxxxxxxxxxxxxx rejstříku nebo xxxxxxxxx rejstříku xxxxxxxx x jiném státě x

(3) Xxx xxxxxxxxxxx xxxxxxx xxxxxxx xxxxxxxxxxx xxxx xxxx způsobilosti xxxxxxxx xxxxxxxxxxx xxxxx Xxxxxxxx unie xx xxxxxxxxx podle zákona x uznávání odborné xxxxxxxxxxx³⁾.

§5

Prokazování xxxxxxxxxxxx xxxx xxxxxxxxx práva x xxxxxxxxxxxxx xxxxxxxx

(1) Xxxxxxxxxx xxxxx x xxxxxxxxxxxxx xxxxxxxx xxxxxxx xxxxxxxxx

x) xxxxxxx z xxxxxxxx xxxxxxxxxxx, xxxxxxxx-xx xx xxxxxxxxxx právo do xxxxxxxx xxxxxxxxxxx, nebo

b) xxxxxxxx xxxx xxxxx xxxxxxxx x nabytí xxxxxxxxxxxx xxxxx, xxxxxxxxxx-xx xx vlastnické právo xx xxxxxxxx xxxxxxxxxxx.

(2) Xxxxxxx xxxxx x xxxxxxxxxxxxx xxxxxxxx xxxxxxx xxxxxxxxx

x) xxxxxxx x xxxxxxxx xxxxxxxxxxx, xxxxxxx-xx xxxxx xxxxxx xxxxxxxxxx xx zápisu x xxxxxxxx xxxxxxxxxxx, xxxx

(3) Xxxxx-xx xxxxxxxxxx xxxxx xxxx xxxxxxx xxxxx x energetickému xxxxxxxx xxxxxxxx xxxxxxx uvedenými x xxxxxxxx 1 xxxx 2, lze xxxxxx právo x xxxxxxxxxxxxx xxxxxxxx xxxxxxxx x xxxxx xxxxxxxx xxxxxxxxxxxxx důvodné xxxxxxxxxxx.

(4) Xxxx-xx xxxxxxx vlastníkem xxxxxxxxxxxxx xxxxxxxx, xxxxxxx xx vyžádání Xxxxx x xxxxxxxxxx xxxxx xxxxxxxxx xxxxxxx uvedenými x odstavcích 1 xx 3.

§6

(1) Xxxxxxxx xxxxx se x žádosti o xxxxxxx licence x xxxxxxxxx přikládaných x xxxxxxx určuje pro xxxxxxxxxxxx xxxxxxx xxxxxxxxxx xxxxxxxxx, xxxxxxxxxx plynu xxxx xxxxxxx tepelné xxxxxxx zákresem xxxxxxxxxx xxxxx, xx kterém xx xxx xxxxxxx xxxxxxxxxx, do xxxxxxxxxxx xxxx xxxx xxxx xxxxxxxxxx x vyznačením

a) xxxxxxxxxxxxx xxxxx a xxxxxxx seznamem katastrálních xxxxx x xxxxxxxxx xxxxx a zákresem xxxxxxxx xxxxxxxxxxxxx zařízení xx katastrální xxxx,

§8

Xxxxxxxxxxx xxxxxxxxxx odpovědného xxxxxxxx

Xxxxxxxxxx xxxxxxxxxxx zástupce, xxxxx xx xxxxxxxxx x žádosti x xxxxxxx licence, obsahuje

a) xxxxx x příjmení xxxxxxxxxxx xxxxxxxx, xxxxx xxxxx, bylo-li xxxxxxxxx, xxxx xxxxx xxxxxxxx,

x) xxxxxxxxx xxxx souhlasu x xxxxxxxxxxx do xxxxxx xxxxxxxxxxx xxxxxxxx,

x) xxxxx x příjmení x případný dodatek xxxxxxxx, xxxxx, popřípadě xxxxxxxx firmu, je-li xxxxxxx zapsán x xxxxxxxxx rejstříku, identifikační xxxxx a xxxx xxxxxxxxxxx xxxxxxxx a

d) xxxxxx ověřený podpis xxxxxxxxxxx xxxxxxxx.

§9

Xxxxxxxx xxxxxxxxxx

(1) Xxxxx xxxxxxx x xxxxxxx, xxxxx x zrušení xxxxxxx pro xxxxxxxxx x energetických xxxxxxxxx xxxx uvedeny v přílohách č. 1 xx 22 x této xxxxxxxx.

§10
